Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Muhajir mobile application, website, NOR artificial-intelligence assistant, community features, digital content, subscriptions and related services (collectively, the “Service”).

By accessing, creating an account for, purchasing, subscribing to or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

All exclusions, disclaimers and limitations contained in these Terms apply to the fullest extent permitted by applicable law. Nothing in these Terms excludes any right or liability that cannot lawfully be excluded or limited.

1. Nature of the Service

Muhajir is an independent digital platform providing information, digital tools, educational resources, community functionality, religious content, artificial-intelligence assistance and other services intended primarily to assist migrants and people living in or planning to move to Italy.

Muhajir is not a government authority and is not affiliated with, endorsed by, or acting on behalf of the Italian Government, the European Union, municipalities, immigration authorities or any other public authority unless expressly stated.

The Service may include information concerning immigration, residence, employment, housing, healthcare, taxation, public services, education, Italian language learning, religious resources, news and other subjects.

Such information is provided for general informational and assistance purposes only.

2. No Professional Advice or Guarantee

Muhajir does not provide legal, immigration, medical, tax, financial, employment or other regulated professional advice.

Information made available through the Service does not replace advice or confirmation from an appropriate authority or qualified professional.

Laws, administrative procedures, eligibility requirements, deadlines, fees, government information and third-party information may change without notice.

Muhajir does not warrant or guarantee the completeness, accuracy, currency, applicability or suitability of information for any particular user's circumstances.

Users are solely responsible for verifying information before relying upon it for important legal, immigration, medical, financial, employment, administrative or personal decisions.

3. NOR Artificial Intelligence

NOR is an artificial-intelligence system and its output may contain errors, omissions, outdated information, misunderstandings or inaccurate conclusions.

NOR responses are generated automatically and do not constitute professional advice, official decisions, representations, warranties or guarantees.

Users remain solely responsible for evaluating and verifying NOR's output and for all decisions and actions taken on the basis of that output.

Muhajir does not guarantee any result arising from the use of NOR.

4. No Guarantee of Outcomes

Muhajir does not guarantee employment, housing, visas, residence permits, citizenship, government benefits, healthcare access, application approvals, appointments, responses from employers or authorities, successful administrative procedures, or any other outcome controlled wholly or partly by third parties.

Muhajir is not responsible for decisions, acts, omissions, delays, refusals, errors or changes made by governments, public authorities, employers, landlords, healthcare providers, businesses, websites, institutions or other independent third parties.

5. Third-Party Services and Infrastructure

The Service depends upon third-party infrastructure and providers, including cloud services, servers, databases, artificial-intelligence services, authentication providers, telecommunications and internet networks, APIs, app stores, payment systems, notification systems, email services and other external technologies.

Muhajir does not control and does not guarantee the continuous operation, availability, performance, security or reliability of third-party systems.

Muhajir shall not be liable, to the fullest extent permitted by law, for outages, downtime, delays, failed requests, failed authentication, network failures, API failures, server failures, database interruptions, AI-provider failures, third-party service restrictions, maintenance, cyber incidents or other interruptions attributable to external infrastructure, providers or circumstances outside Muhajir's control.

Temporary interruption, reduced performance or temporary unavailability of the Service does not by itself create an entitlement to damages, compensation or reimbursement, except where a specific remedy is required by mandatory applicable law.

6. Availability, Changes and Discontinuation

Continuous or uninterrupted availability of the Service is not guaranteed.

Muhajir may maintain, update, modify, replace, restrict, suspend or discontinue features or functionality for operational, security, legal, technical or commercial reasons.

Free features, usage allowances, AI-message limits, advertising arrangements, trials and promotional benefits may be introduced, modified or withdrawn.

Changes affecting paid digital services remain subject to mandatory applicable consumer law.

7. User Responsibility and Misuse

Users are solely responsible for their use of the Service, their account activity, information they submit and decisions they make using the Service.

Users must not use Muhajir for unlawful, fraudulent, abusive, deceptive, harmful or unauthorized purposes.

Prohibited conduct includes attempting to:

circumvent subscriptions, quotas or device/account restrictions;
create accounts to evade usage limits or enforcement;
interfere with or attack the Service;
gain unauthorized access to systems or data;
exploit vulnerabilities;
scrape or automate access without authorization;
distribute malicious software;
impersonate others;
commit fraud;
harass or threaten users;
publish unlawful content;
violate intellectual-property or privacy rights; or
use Muhajir to facilitate unlawful activity.

The user bears responsibility for consequences arising from the user's unlawful, fraudulent, unauthorized or prohibited conduct.

Muhajir may remove content and restrict, suspend or terminate accounts to protect the Service, its users, its rights or to comply with legal obligations.

8. Community and User Content

Community posts, messages, comments, profiles and other user-generated content are created by independent users and do not represent Muhajir.

Muhajir does not endorse, guarantee or assume responsibility for statements, offers, representations or conduct of users.

Users are responsible for content they publish and for ensuring that they possess all necessary rights to publish it.

Users retain ownership of their content but grant Muhajir a non-exclusive licence necessary to host, process, display, transmit, moderate and operate that content within the Service.

Muhajir may moderate or remove content and restrict accounts where necessary to enforce these Terms, protect users, comply with law or protect the Service.

No moderation system guarantees detection or removal of every unlawful, misleading, offensive or harmful item.

Muhajir is not a party to private agreements, transactions, meetings, employment arrangements, rentals or other relationships entered into between users.

9. Third-Party Links, Jobs, Housing and External Content

Muhajir may display or link to information, websites, vacancies, housing opportunities, news, businesses, government resources and other content supplied or operated by third parties.

A link, listing or reference does not constitute a guarantee or endorsement.

Muhajir does not guarantee that third-party information is accurate, legitimate, safe, current or continuously available.

Users are responsible for independently checking third parties before submitting documents, personal information, money or entering into agreements.

10. Health and Emergency Information

Health-related content is provided for general informational purposes only and does not constitute diagnosis, treatment or medical advice.

Neither Muhajir nor NOR is an emergency service.

Users requiring medical assistance or facing an emergency must contact qualified healthcare professionals or the appropriate emergency services.

11. Religious Features

Religious features may include Quran content, prayer times, Adhan, Qibla calculations, Adhkar, Duas, Tasbih and related resources.

Technical calculations may be affected by location data, device settings, sensors, calculation methods and external data providers.

Muhajir does not guarantee absolute accuracy of calculated prayer times, Qibla direction or other technically generated religious information.

12. Accounts and Security

Users are responsible for protecting their devices and account access and must not knowingly permit unauthorized use of their accounts.

Muhajir may apply security measures, terminate sessions, require authentication or restrict access where necessary to protect accounts, users or the Service.

No internet-connected platform can guarantee absolute security or immunity from cyberattack.

13. Subscriptions, Payments and Refunds

Paid subscriptions are subject to the price, billing period and benefits displayed at the time of purchase.

Purchases processed through Google Play, Apple App Store or another payment platform are also subject to the applicable platform's billing, cancellation and refund procedures.

A temporary outage, maintenance period, third-party infrastructure failure or temporary inability to access an individual feature does not automatically entitle a user to compensation or refund.

Any refund, price reduction, cancellation or other remedy required by mandatory consumer law remains unaffected.

14. Intellectual Property

Muhajir, NOR, the software, interface, branding, logos, designs, original books, written material, educational content, graphics and other original proprietary material are protected by applicable intellectual-property law.

Except where expressly permitted, users may not copy, reproduce, republish, distribute, sell, commercially exploit, reverse engineer or circumvent technical protection applied to proprietary Muhajir content.

No ownership right is transferred to a user by access to the Service.

Third-party material remains the property of its respective rights holders.

15. Data and Storage

Muhajir is not intended to serve as the user's sole permanent backup or archival system.

No electronic, cloud or internet-based storage system can guarantee permanent availability or protection against every possible technical failure, cyber incident or external infrastructure failure.

Users are responsible for maintaining independent copies of important information where appropriate.

Personal data is handled in accordance with the Muhajir Privacy Policy and applicable data-protection law.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.

Muhajir disclaims all warranties, representations and guarantees not expressly required by mandatory law, including warranties concerning uninterrupted availability, error-free operation, accuracy of information, fitness for a particular purpose, compatibility, third-party services and achievement of any particular result.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Muhajir, its owners, operators, personnel and service partners shall not be liable for indirect, incidental, consequential, special, exemplary or purely economic losses arising from or connected with use of, inability to use, misuse of, or reliance upon the Service.

This includes, where legally excludable, loss of opportunity, loss of income, loss of business, loss of data, interruption, reputational loss and losses resulting from third-party conduct, AI output, external information, service outages or decisions made by users.

Muhajir shall not be responsible for losses caused by:

user misuse or violation of these Terms;
reliance on information that should have been independently verified;
user-generated content or interactions between users;
acts or decisions of governments or independent third parties;
external websites or services;
third-party infrastructure or service failures;
circumstances outside Muhajir's control.

Nothing in these Terms creates liability beyond that imposed by mandatory applicable law, and nothing excludes liability that applicable law expressly prohibits from being excluded.

18. Force Majeure

Muhajir shall not be responsible for failure, interruption or delay caused by events beyond its control, including major internet or telecommunications failures, cloud or infrastructure outages, cyberattacks, power failures, natural disasters, war, terrorism, civil disorder, governmental measures, epidemics, sanctions or comparable events.

19. Suspension and Termination

Muhajir may restrict, suspend or terminate accounts or access in cases of abuse, fraud, unlawful conduct, security threats, circumvention of technical restrictions, serious or repeated violations of these Terms, or where required to protect the Service or comply with law.

Users may stop using Muhajir at any time and may request account deletion through the available account-deletion process.

20. Governing Law and Mandatory Consumer Rights

These Terms are governed by Italian law.

If the user qualifies as a consumer, nothing in these Terms deprives the user of mandatory protections, remedies or jurisdictional rights that applicable Italian or European Union consumer law does not permit to be waived.

If any provision is held invalid or unenforceable, it shall be limited or severed only to the extent necessary, and the remaining provisions shall continue in effect.

21. Changes to These Terms

Muhajir may update these Terms to reflect changes in law, technology, security, infrastructure, functionality or business operations.

The current version and its “Last Updated” date will be published through Muhajir or its website. Where mandatory law requires specific notice or consent, the applicable legal requirements will be followed.
